2022 ALERT
Immediate Monetization of Visa/Mastercard
Assets Available to Entities Accepting Credit
or Debit Cards

In re: Payment Card Interchange Fee and Merchant Discount Antitrust Litigation,

Case No. 05-md-01720, U.S. District Court of the Eastern District of New York.

What is the Visa/MasterCard SETTLEMENT?

In the Visa/MasterCard antitrust class-action lawsuit, a group of merchants alleged that banks and
credit card companies unlawfully entered into agreements to raise fees that merchants pay when
customers make transactions using a credit or debit card. The merchants alleged that Visa,
MasterCard, and many of the country’s largest banks conspired to raise fees. On September 18,
2018 Visa Inc., MasterCard Inc., and banks including Bank of America, Barclays, JPMorgan
Chase, Citibank, and SunTrust agreed to end this long-running, multi-district, price-fixing case and
to pay as much as $6.2 billion, the largest-ever class-action settlement of an antitrust case.

Why is the Visa/MasterCard Settlement Important NOW?

The settlement agreement has been approved by the U.S. District Court. Visa/MasterCard
merchants are eligible for the settlement fund and, depending upon the volume of credit and debit
card transactions from January 1, 2004 through January 25, 2019, an individual company’s
settlement could be substantial. Eligible companies will need to take action in order to receive their
recoveries. Recoveries will not be available if no action is taken. Options for eligible companies in
the Visa/MasterCard Interchange Fee Settlement include:

  • Monetizing Legal Claim

  • Class Action Settlement Fund

  • Litigation

  • Do Nothing

If You Do Nothing, You Will Get Nothing.
